ARCAfrogEstablishesPermanentReductionsAndExtraordinaryRebateForTaxSanctions

TheAgencyofRevenueandCustomsControl, knownbyitsSpanishinitialismARCA, introducedautomaticreductionsinadministrativepenaltiesformicroenterprises,smallandmedium-sizedenterprises,individuals,estateswithoutbequestandnonprofitorganizationsunderLaw27.826,effectiveOctober9,2026. Thepermanentbenefitprovidesa25%discountondeterminedformalpenalties,providedthecontributorsarenotclassifiedasNationalMajorTaxpayers.

Apermanentreductionwithoutadditionalprocedure

Thefirstbenefitoperatesasofrightanddoesnotrequireaspecialapplication. Itcoverscertainformaloffenses,includingfailuretosubmitstatutoryreturns,noncompliancewithARCArequirements,violationsofgeneralformaldutiesandbreachesoftaxinformationregimes.AccordingtotheLaw,afineof440,000pesosforfailuretofillasocietyreturnwouldfallto330,000pesos,whileforsolethetaxpayerwoulddeclinefrom220,000to165,000pesos.

• Thepermanentdiscountis25%oncertainformalpenalties.
• Eligiblecontributorsinclude microenterprises, smallandmedium-sizedenterprises,individuals,estateswithoutbequestandnonprofitorganizations.
• ThebenefitisavailableprovidedthecontributorsarenotclassifiedasNationalMajorTaxpayers.
• Themaximumfineforresistancetotaxinspectionwouldfallfrom35millionto26.25millionpesos.

Anadditionalrebateforoldsanctions

Thesecondmechanismprovidesa50%discountonpenaltiesforoffensescommittedbeforeOctober9,2026,whenrelatedobligationsbecameduefromJanuary2,2026. Toqualify,thesanctionmustnotbefinalor,ifit isalreadyfinal,itmustremainunpaid. Thisrebateisnotanunrestrictedamnesty:theunderlyingtaxobligationmustbecompliedwithbeforethebenefitissoughtoronasimultaneousbasis.

ARCAalsoimposesproceduralconditions.Acceptingthediscountrequiresrecognizingwithoutchallengeboththeportionofthesanctionthatwillnotbereducedandanyrelatedobjection. Applicantswithanongoingdisputemustalsoresponsibleforthecosts. Sanctionsthatwerealreadypaidwouldnotgeneratearighttorefund.
